This paper posits a feminist aesthetic of reading, ‘re-captivation,’ which accounts for both the reader's pleasure and his/her ethical responsibility. Re-captivation is distinguished by its introspective and ethical characteristics; it is a pleasure informed by the pain of misrecognition, i.e. acknowledgement of one's own complicity in systems of oppression. After a brief explanation of re-captivation, this paper describes my experience viewing the film Menace II Society. In 1988, Colorado instituted a new regulatory system that was opposed by psychologists and social workers. We surveyed 306 psychotherapists about their attitudes regarding this system, which included profession-specific licensing boards and an omnibus board to handle grievances. Social workers and psychologists, members of more established professions, opposed creating an omnibus licensing board and favored the return of profession-specific grievance functions. Members of the newer professions and unlicensed psychotherapists were not as opposed to omnibus boards. All groups agreed in their (...) positive ratings of the performance of the Colorado grievance structure. These results are discussed in terms of "capture" theory, which postulates that professions capture governmental regulation and use it for their own interests. (shrink)

Agreement was slightly less strong that IESPs should train students in skills related to managing value conflicts among different stakeholders. The primary challenges to incorporating social ethics into the curriculum were related to the lack of materials and expertise for delivery, though challenges such as ethics being marginalized in relation to environmental science content were also prominent. Challenges related to students’ interest in ethics were considered less problematic. Respondents believed that social ethics are most effectively delivered when incorporated into existing courses, and they preferred case studies or problem-based learning for delivery. Insight experiences are sudden, persuasive, and can accompany valuable new ideas in science and art. In this preregistered experiment, we aim to validate a novel visceral and continuous measure of insight problem solving and to test whether real-time and embodied feelings of insight can predict correct solutions. We report several findings. Consistent with recent work, we find a strong positive relationship between Aha moments and accuracy for problems that demand implicit processing. We also found that the intensity of the insight (...) experience further predicted the accuracy of solutions and participants naturally embodied the intensity of their insight experiences by squeezing the dynamometer more tightly. Intriguingly, this unintentional embodiment further predicted the accuracy of solutions. We suggest that the dynamometer complements previous measures by (1) simultaneously capturing both process and feeling in real-time, (2) highlights the value of measuring Aha moments on a continuum of intensity, and (3) firmly establishes that the impulsive feeling of Aha can carry information about the veracity of an idea. We discuss the findings in light of a recent theoretical account of how feelings of insight may act as a heuristic to select ideas from the stream of consciousness. (shrink)

Is it possible to advance democracy by empowering ordinary citizens to make key decisions about the design of political institutions and policies? In 2004, the government of British Columbia embarked on a bold democratic experiment: it created an assembly of 160 near-randomly selected citizens to assess and redesign the province's electoral system. The British Columbia Citizens' Assembly represents the first time a citizen body has had the power to reform fundamental political institutions. It was an innovative gamble that has been (...) replicated elsewhere in Canada and in the Netherlands, and is gaining increasing attention in Europe as a democratic alternative for constitution-making and constitutional reform. In the USA, advocates view citizens' assemblies as a means for reforming referendum processes. The devastating toll of gun violence has given rise to hundreds of lawsuits seeking justice on behalf of victims and their families. A significant number of challenges against gun companies, however, are blocked by courts' broad reading of the Protection of Lawful Commerce in Arms Act — a federal statute often interpreted to shield the gun industry from civil liability. This article reexamines PLCAA in light of the Supreme Court's recent federalism caselaw, which counsels courts to narrowly construe federal laws (...) that could otherwise upset the balance of power between states and the federal government. Since PLCAA infringes on traditional areas of state authority, the Supreme Court's federalism jurisprudence requires lower courts to interpret PLCAA narrowly, to not bar states from imposing negligence, nuisance, product liability, or other common law liability on gun companies. Reading PLCAA in line with federalism principles would preserve states' traditional authority over their civil justice laws, and enable gun violence victims, and their families, to hold gun companies responsible for wrongdoing. False “Aha!” moments can be elicited experimentally using the False Insight Anagram Task (FIAT), which combines semantic priming and visual similarity manipulations to lead participants into having “Aha!” moments for incorrect anagram solutions. In a preregistered experiment (N = 255), we tested whether warning participants and explaining to them exactly how they were being deceived, would reduce their susceptibility to false insights. We found that simple warnings did not reduce the incidence of false insights. On the other hand, participants who (...) were given a detailed explanation of the methods used to deceive them experienced a small reduction in false insights compared to participants given no warning at all. Our findings suggest that the FIAT elicits a robust false insight effect that is hard to overcome, demonstrating the persuasive nature of false insights when the conditions are ripe for them. Concerns for safety and security as South Africa’s hosting of 2010 FIFA World Cup draws nearer highlight the degree to which South Africa’s reputation for a relatively peaceful transition from Apartheid has been replaced by its reputation for violent crime. Its transition, and the peacebuilding efforts that followed it, are not completely unrelated to its current high levels of violent crime. In fact, this article argues that there were a number of issues South Africa’s peacebuilding process failed to address that (...) are relevant to the country’s violent crime situation. A significant reason for this failure was an inability or unwillingness to engage the full spectrum of Apartheid’s violence with equal rigour. Apartheid inflicted structural violence, through its racially oppressive laws, as well as physical violence, through enforcing its laws and suppressing its opposition, on the people of South Africa. Peacebuilding in South Africa primarily focused on Apartheid’s physical violence. Through the work of the Truth and Reconciliation Commission, the focus was narrowed down further to physical political violence. Due to this narrow focus, it did not attend effectively to non-political violence – which includes gender-based violence, the esteem violence had attained during and due to Apartheid, disarming the country of illegal firearms, and narrowing the income gap between the country’s rich and poor. While South Africa proudly claims ownership of its conflict resolution and peacebuilding processes, it still emulated predominant models of building peace through liberal democracy and a market economy. These models have been drawn from Western success stories in diminishing interstate conflict, while South Africa is a developing country that was recovering from an intrastate conflict. Pursuing these models has had benefits for South Africa, but not in many of the ways it needed in order to effectively prevent a surge in criminal violence in the wake of Apartheid. (shrink)

If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

Purpose Medical students receive a varying amount of training in medical ethics and are expected to navigate clinical ethical dilemmas innately. There is little literature on attempts to navigate ethical dilemmas experienced during early clinical experiences and whether current curricula prepare students for these dilemmas. This study explores the different ethical dilemmas experienced by medical students on their third-year clerkships and analyzes the factors, sources, and resolutions proposed by them.Methods From 2016 to 2018, third-year medical students completed a written assignment (...) to describe, analyze, and reflect on a clinical situation in which they experienced an ethical dilemma. They identified specific ethical dilemmas present, potential preventative and aftermath solutions, and reflected on their professional development from their experience. The research team utilized applied thematic analysis to identify themes and patterns in the data. A thematic matrix was utilized to examine similarities and differences across medical students.Results Of the 162 reflections, 144 (88.9%) students indicated an ethical dilemma that included issues related to autonomy and beneficence. Of these, 116 (71.6%) students found the two ethical principles in direct conflict. Students identified three common sources of this conflict: lack of communication; unclear understanding of clinical policies regarding family authority and psychiatric capacity; and medical negligence. Lastly, students suggested different solutions for dealing with and preventing this conflict.Conclusion Our findings suggest that an overwhelming number of students face ethical challenges when confronted with medical situations that raise conflicts between autonomy and beneficence. Their recommended solutions reveal an appeal among students to have tools and strategies in place to ease the need to make difficult decisions. Medical students might be better served by learning about the complexities of ethical decision-making and the likelihood of experiencing moral distress when they feel an inability to implement what they envision as the best solution. Increasing genetic knowledge over the last decade has enabled hundreds of genetic variants associated with inherited cardiac conditions to be identified, many of which cause increased risk of sudden cardiac death. While individually these conditions are rare, taken together they impose a significant burden. The severity of these conditions—the possibility that they might cause sudden unheralded death of a teenager or young adult—juxtaposed with uncertainty about the pathology linked with many of the genetic variants is significant in terms of professional (...) practice because, increasingly, clinicians have been encouraged to cascade out genetic testing from the proband or consultand to other family members who may be at risk of developing the same condition. This process often involves sharing human tissue samples, DNA or personal information. This paper reviews the legal and regulatory frameworks which may apply when tissue and DNA samples are collected, used and retained, both for the purpose of diagnosis and for benefiting other family members, when a suspected or definitive diagnosis of an inherited cardiovascular condition is made. Sometimes the interests of family members may conflict, and it may be difficult for practitioners to reconcile the interests of one family member with another, particularly if the balance of benefits and harms from testing is unclear. The paper then examines some of the ethical tensions which may arise in practice and concludes that all involved should be conversant with the legal and ethical frameworks that apply. (shrink)

We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. Studies of reasoning have often invoked a distinction between a natural or ordinary consideration of the premises, in which they are interpreted, and even distorted, in the light of empirical knowledge, and an analytic or logical consideration of the premises, in which they are analysed in a literal fashion for their logical implications. Two or three years of schooling have been seen as critical for the spontaneous use of analytic reasoning. In two experiments, however, 4-year-olds who were given brief instructions (...) that prompted use of an analytic approach continued to adopt this approach one week later. Thus, when given syllogistic problems in which the major premise was incongruent with their empirical knowledge (e.g. "All snow is black"), instructed children reasoned more accurately from that premise both immediately and a week later as compared to children given only a basic introduction. A third experiment showed that instructions also improved 4-year-olds' performance on hard-to-imagine, abstract material (e.g."All mib is white"). Similarities between the effects of brief instruction and of schooling are discussed. (shrink)

A Philosopher Looks at Quantum Mechanics’ (Putnam [1965]) explained why the interpretation of quantum mechanics is a philosophical problem in detail, but with only the necessary minimum of technicalities, in the hope of making the difficulties intelligible to as wide an audience as possible. When I wrote it, I had not seen Bell ([1964]), nor (of course) had I seen Ghirardi et al. ([1986]). And I did not discuss the ‘Many Worlds’ interpretation. For all these reasons, I have decided to (...) make a similar attempt forty years later, taking account of additional interpretations and of our knowledge concerning non-locality. (The Quantum Logical interpretation proposed in Putnam [1968] is not considered in the present paper, however, because Putnam [1994b] concluded that it was unworkable.) Rather than advocate a particular interpretation, this paper classifies the possible kinds of interpretation, subject only to the constraints of a very broadly construed scientific realism. Section 7 does, however, argue that two sorts of interpretation—ones according to which a ‘collapse’ is brought about by the measurement (e.g. the traditional ‘Copenhagen’ interpretation), and the Many Worlds interpretation or interpretations—should be ruled out. The concluding section suggests some possible morals of a cosmological character. The move towards the use of new technologies and the new focus on citizen engagement in Scotland provides the opportunity for e-democracy to emerge. Working towards the goal of e-democracy, the International Teledemocracy Centre is developing a body of ICT, supporting skills, tools and techniques, designed specifically to facilitate the use of technology, capable of enhancing democratic engagement. This paper begins to articulate how citizens are engaging with government and with their elected representatives about issues that concern them, using technology (...) specially designed for the purpose. The paper examines the nature of e-democracy and considers concepts of democracy, issues of democratization, and issues surrounding citizen access and participation. In addition, the paper discusses the design and use of two electronic tools developed by the ITC between 1999 and 2001 i. e. e-consultant and e-petitioner. Finally, the paper presents analyses of findings drawn from research to monitor and evaluate the use of these tools and the arrangements which accompany their entry into society. (shrink)

La tecnología reproductiva alcanzó un nuevo récord en 2017 con el nacimiento de un infante de sexo femenino que se desarrolló dentro del útero de una donante fallecida. No se registraron complicaciones inusuales en el procedimiento ni en lo referente a la salud de la madre. Tres años antes, ensayos clínicos suecos señalan el nacimiento de dos infantes de sexo masculino provenientes de úteros extraídos de donantes vivas, vinculados a las madres. La ciencia había logrado curar el factor de infertilidad (...) uterino absoluto (AUFI por sus siglas en inglés), en mujeres con esta condición. Es importante que, si bien algunos ajustes en el procedimiento dominarán el desarrollo futuro, especialmente en los aspectos clínicos, no debemos olvidar las consideraciones éticas. Por lo anterior, esta revisión documental se centra en cómo se ven los trasplantes de útero de donantes fallecidas dentro de los datos disponibles en tres contextos principales: la antropología del ser humano, la medicina y la sociología, con énfasis en ciertas construcciones culturales de la sociedad liberal moderna. Subyacente al diagnóstico está el hecho de que el útero es un órgano no vital en la fisiología humana, y los trasplantes de útero de donantes fallecidas (DD UTX por sus siglas en inglés) plantean nuevos desafíos en la ética. En esta revisión se presentan los sesgos observados en los datos, las limitaciones de un procedimiento de menos de diez años y las conclusiones a las que llegamos. (shrink)

L’idea che vi sia una netta dicotomia tra fatti e valori è uno dei dogmi dell’empirismo. Secondo questa concezione, i giudizi fattuali, in quanto verificabili o falsificabili empiricamente, riguardano le aree di razionalità «pura» e omogenea e sono ancorati naturalisticamente al mondo. Gli enunciati di valore, invece, sarebbero da relegare nella sfera di ciò che è semplicemente «soggettivo», emotivo, irrazionale. Questo assunto, che ha dominato per molto tempo le scienze e la filosofia, è stato messo in dubbio dai pragmatisti e (...) da alcuni dei più influenti pensatori contemporanei, che, intervenendo al dibattito sull’oggettività dell’etica, hanno mostrato come la presunta eterogeneità tra giudizi descrittivi e giudizi valutativi sia ormai insostenibile. This article aims to analyze the fundamentals of Alain de Libera’s archeology of the subject. Two central thesis will be investigated here: Descartes arrived at his theory of the subject in a controversy with Hobbes and Regius, in order to avoid the reduction of the individual to bodily life and passivity; Thomas Aquinas and Peter John Olivi were responsible for a mature approach to the theme of the subject, which had been elaborated by Patristic authors, eminently by Augustine of Hippo, who formulated a comprehensive scheme of the self as support and agent. Standard models of adolescent risk taking posit that the cognitive abilities of adolescents and adults are equivalent, and that increases in risk taking that occur during adolescence are the result of socio emotional differences in impulsivity, sensation seeking, and lack of self-control. Fuzzy-trace theory incorporates these socio emotional differences. However, it predicts that there are also cognitive differences between adolescents and adults, specifically that there are developmental increases in gist-based intuition that reflects understanding. Gist understanding, as opposed to verbatim-based analysis, (...) generally has been hypothesized to have a protective effect on risk taking in adolescence. Gist understanding is also an essential element of informed consent regarding risks in medical decision- making. Evidence thus supports the argument that adolescents’ status as mature minors should be treated as an exception rather than a presumption, because accuracy in verbatim analysis is not mature gist understanding. Use of the exception should be accompanied by medical experts’ input on the bottom-line gist of risks involved in treatment. (shrink)

There is a widespread assumption that the classical work in philosophical semantics of Saul Kripke (1980) and Hilary Putnam (1975) has taught us that the essences of natural kinds of substances, such as water and gold, are discoverable only a posteriori by scientific investigation. It is such investigation, thus, that has supposedly revealed to us that it is an essential property of water that it is composed of H2O molecules. This is the way in which Scott Soames, in a (...) recent paper, makes the point in the case of water and H2O: [Here is] how a Kripkean explanation of the necessary a posteriority of [‘Water = H2O’] would go – or at any rate my version of it. The account holds that ‘water’ is a non-descriptive, directly-referential term designating a substance – where substances are taken to be physically constitutive kinds (instances of which share the same basic physical constitution). It is further assumed that a kind of this sort may have different instances in different world-states, and that if a and b are kinds with the same instances in all possible world-states, then a is b. These are clearly metaphysical assumptions, to which we add the natural corollary that for any substance, s, if, in some possible world-state, instances of s have a certain molecular structure, then instances of s have that structure in every world-state. In other words, we assume that it is an essential property of a substance that instances of it have the molecular structure they do. From this it follows that [‘Water = H2O’] is necessary if true, and that ‘H2O’– which I take to be equivalent to ‘the substance instances of which have a molecular structure with two hydrogen atoms and one oxygen atom’– is a rigid designator. Being true, [‘Water = H2O’] is, therefore, necessary. Since knowing the proposition it expresses requires knowing of a certain substance that its instances have a particular chemical structure, [‘Water = H2O’] is knowable only a posteriori. ‘Water is H2O’ is one of the most frequently cited sentences in analytic philosophy, thanks to the seminal work of Saul Kripke and Hilary Putnam in the 1970s on the semantics of natural kind terms. Both of these philosophers owe an intellectual debt to the empiricist metaphysics of John Locke's Essay Concerning Human Understanding, while disagreeing profoundly with Locke about the reality of natural kinds. Locke employs an intriguing example involving water to support his view that kinds (or ‘species’), (...) such as water and gold, are the workmanship of the human mind. This is the point of his story about a winter visitor to England from Jamaica, who is astonished to find that the water in his basin has turned solid overnight, and proceeds to call it ‘hardened water’. Locke criticizes this judgement, maintaining that it is more consonant with common sense to regard water and ice as different kinds of substance. Putnam, by implication, disagrees. Deploying his imaginary example of Twin Earth—a distant planet where a watery-looking substance, XYZ, rather than H2O, fills the oceans and rivers—he maintains that common sense supports the judgement that XYZ and H2O, despite their superficial similarity, are not the same kind of substance, precisely because their molecular compositions are different. Here it will be argued that both views are mistaken, but that, in this dispute, Locke has more right on his side than his modern opponents do. (shrink)

Natural kind essentialism is a specification of the intuitive idea that there are some mind-independent or objective categories in nature. These categories are thought to be characterised by a shared essence, which may involve intrinsic or extrinsic properties, mechanisms, or causal history. While the ontological basis of natural kinds has its roots in antiquity and especially Aristotle, the contemporary notion of a “natural kind” in philosophical discussion is often traced to William Whewell’s and John Stuart Mill’s work in the 1800s. (...) In its more modern form, natural kind essentialism was popularised in the 1970s mainly by Saul Kripke and Hilary Putnam. Traditionally, natural kind essentialism has been associated with intrinsic and microstructural properties, but contemporary work has made it clear that more refined versions of natural kind essentialism may have to accept extrinsic or relational essences. En m'appuyant sur le réalisme interne de Hilary Putnam, je critique deux éléments essentiels de la solution proposée par Fodor, à savoir la relation de dépendance asymétrique et l'individuation des objets de la référence. There is a paradox, or self-defeating supposition in the core of constructionism, for it would appear that any attempt to resolve a dispute in historical interpretation within a convention of self-contained criteria of confirmation by appealing to justificatory criteria outside the convention -to wit, the theory of constructionism -is self-defeating. Through the theoretical consideration of historians isolated in a vat, following Hilary Putnam's metaphor, it becomes clear that the vat language of the historians does not have the possibility of (...) referring, intrinsically or extrinsically, to anything external. The implications of the vat metaphor for an understanding of historical inquiry are: 1) we need to recognize and insist upon different levels of abstraction both in historical writing and in the justification of its claims; 2) applied to history, the set paradox reveals the need to recognize that at the most abstract level of consideration we encounter inescapable incoherence; and 3) we need to recognize that in some important sense reference must be completed in the world, regardless of the problems in characterizing this sense philosophically. RésuméDans A Theory of Content Jerry Fodor fait déboucher sa théorie représentationnelle de l'esprit sur une psychosémantique physicaliste et atomiste. Cette théorie externaliste de la signification –the Asymmetric Dependency Theory– fournit une solution entièrement naturalisée au second problème de Brentano, c'est‐à‐dire celui de l'objet référentiel. En m'appuyant sur le réalisme interne de Hilary Putnam, je critique deux éléments essentiels de la solution proposée par Fodor, à savoir la relation de dépendance asymétrique et l'individuation des objets de la référence. Cette (...) critique vise à montrer que le problème de la naturalisation et celui de la détermination sémantique ne sauraient être résolus simultanément. En outre, la détermination ontologique des objets de la référence implique inévitablement le principe de relativité conceptuelle. Using payment to recruit research subjects is a common practice, but it raises ethical concerns that coercion or undue inducement could potentially compromise participants’ informed consent. This is the first national study to explore the attitudes of IRB members and other human subjects protection professionals concerning whether payment of research participants constitutes coercion or undue influence, and if so, why. The majority of respondents expressed concern that payment of any amount might influence a participant’s decisions or behaviors regarding research participation. (...) Respondents expressed greater acceptance of payment as reimbursement or compensation than as an incentive to participate in research, and most agreed that subjects are coerced if the offer of payment makes them participate when they otherwise would not or when the offer of payment causes them to feel that they have no reasonable alternative but to participate . Views about undue influence were similar. We conclude that human subjects protection professionals hold expansive and inconsistent views about coercion and undue influence that may interfere with the recruitment of research participants and impede valuable research.
